{"id":10118,"date":"2026-02-13T14:22:47","date_gmt":"2026-02-13T14:22:47","guid":{"rendered":"https:\/\/wpinitiate.com\/echo-test\/demo973e36f5\/2026\/02\/13\/trump-discovers-that-the-road-to-autocracy-is-lined-with-potholes-vox-com\/"},"modified":"2026-02-13T14:22:47","modified_gmt":"2026-02-13T14:22:47","slug":"trump-discovers-that-the-road-to-autocracy-is-lined-with-potholes-vox-com","status":"publish","type":"post","link":"https:\/\/wpinitiate.com\/echo-test\/demo973e36f5\/2026\/02\/13\/trump-discovers-that-the-road-to-autocracy-is-lined-with-potholes-vox-com\/","title":{"rendered":"Trump discovers that the road to autocracy is lined with potholes &#8211; vox.com"},"content":{"rendered":"<div id=\"zephr-anchor\">\n<p>A little over a year into his second presidency, President Donald Trump has yet to turn America into a pure, uncut authoritarian nightmare \u2014 but not for lack of trying.<\/p>\n<p>Back in January 2025, if you asked a liberal what the new Trump administration would do in the worst case scenario, they would probably have said things like:<\/p>\n<div>\n<p>\u2022 Bring <a href=\"https:\/\/www.nytimes.com\/2025\/11\/24\/nyregion\/james-comey-case-dismissed.html\">bogus charges<\/a> <a href=\"https:\/\/www.nytimes.com\/2026\/01\/11\/us\/politics\/jerome-powell-fed-inquiry-trump.html\">against<\/a> its <a href=\"https:\/\/www.nytimes.com\/2026\/01\/08\/us\/politics\/letitia-james-trump-justice-department.html\">political enemies<\/a>, up to and including Democratic lawmakers.<\/p>\n<\/div>\n<div>\n<p>\u2022 Strong-arm <a href=\"http:\/\/www.vox.com\/politics\/461887\/jimmy-kimmel-suspension-air-abc-charlie-kirk-nexstar\">television networks<\/a> to de-platform critical comedians.<\/p>\n<\/div>\n<p>\u2022 Deploy the military to <a href=\"https:\/\/www.democracydocket.com\/news-alerts\/mapped-trumps-deployment-of-national-guard-troops\/\">Democratic cities<\/a> to put down protests against its policies.<\/p>\n<div>\n<p>\u2022 Empower immigration enforcement agents to <a href=\"http:\/\/www.vox.com\/politics\/474637\/ice-shooting-minnesota-renee-nicole-good-trump\">kill American citizens<\/a> with total impunity.<\/p>\n<\/div>\n<p>The president has already done all of these things.<\/p>\n<p>And yet, on each front, pushback from the judiciary and civil society has either beaten back his assertions of dictatorial power or at least constrained them.<\/p>\n<p>This week brought a particularly vivid illustration of this dynamic in which Trump cooks up some cartoonishly tyrannical plot, only for America\u2019s citizens and constitutional order to force him into retreat.<\/p>\n<div>\n<p id=\"its-still-legal-to-advocate-against-war-crimes\">\n<h2><strong>It\u2019s still legal to advocate against war crimes<\/strong><\/h2>\n<\/p>\n<\/div>\n<p>On Tuesday, Trump\u2019s Justice Department <a href=\"http:\/\/www.vox.com\/the-logoff-newsletter-trump\/478981\/grand-jury-reject-indictment-kelly-slotkin-democratic-lawmakers-illegal-orders\">attempted to secure an indictment<\/a> against six Democratic lawmakers for the crime of exercising their First Amendment rights.<\/p>\n<p>Specifically, the Democrats \u2014 including Senators Mark Kelly and Elissa Slotkin \u2014 released <a href=\"https:\/\/www.instagram.com\/reels\/DRMxZAnlUF9\/\">a video<\/a> last fall in which they warned those serving in America\u2019s military and intelligence agencies that \u201cthreats to our Constitution aren\u2019t just coming from abroad, but from right here at home.\u201d<\/p>\n<p>The lawmakers, all former soldiers or intelligence operatives themselves, reminded their counterparts that they \u201cmust refuse illegal orders.\u201d They did not explicitly question the legality of any specific military operation.<\/p>\n<p>But the video came months after Defense Secretary Pete Hegseth <a href=\"http:\/\/www.vox.com\/politics\/471075\/trump-hegseth-strike-venezuela-drug-boats-war\">allegedly ordered<\/a> the military to \u201ckill everybody\u201d aboard a Venezuelan fishing boat \u2014 a command that was illegal on an array of different levels.<\/p>\n<p>Some might struggle to see what law the Democrats\u2019 message could have broken: How could it be illegal for an elected official to encourage compliance with the constitution or Geneva Convention?<\/p>\n<p>Alas, the president decided that this was not only a crime, but a capital one. On Truth Social, Trump <a href=\"https:\/\/www.nytimes.com\/2026\/02\/10\/us\/politics\/trump-democrats-illegal-orders-pirro.html?partner=slack&#038;smid=sl-share\">declared<\/a> the Democrats had committed \u201cSEDITIOUS BEHAVIOR, punishable by DEATH!\u201d and reposted a supporter\u2019s call to \u201cHANG THEM GEORGE WASHINGTON WOULD !!\u201d<\/p>\n<p>In this administration, it seems, the Justice Department\u2019s first loyalty is to the president\u2019s whims rather than America\u2019s laws. So, it was shocking but unsurprising that the US attorney\u2019s office in Washington actually tried to indict the so-called \u201c<a href=\"https:\/\/x.com\/PeteHegseth\/status\/1993008532187148582\">seditious six<\/a>\u201d this week.<\/p>\n<p>Yet it was also remarkable that the DOJ failed. Grand juries almost always side with the prosecution, as they hear only the government\u2019s side of a given case. And to approve an indictment, they must merely determine that there is \u201cprobable cause\u201d that the accused <em>may<\/em> have committed a crime.<\/p>\n<p>Yet, the administration could not clear this low bar.<\/p>\n<p>This is part of a broader pattern. The DOJ\u2019s attempts to prosecute some of Trump\u2019s other adversaries, such as former <a href=\"https:\/\/www.npr.org\/2025\/11\/25\/nx-s1-5619597\/judge-dismisses-comey-james-cases-after-finding-prosecutor-was-unlawfully-appointed\">FBI director James Comey<\/a> and New York Attorney General <a href=\"http:\/\/www.vox.com\/the-logoff-newsletter-trump\/470336\/comey-james-cases-lindsey-halligan-us-attorney-kelly-investigation\">Letitia James,<\/a> were also quickly dismissed by judges and grand juries. And although the outcome of the administration\u2019s <a href=\"https:\/\/www.nytimes.com\/2026\/01\/11\/us\/politics\/jerome-powell-fed-inquiry-trump.html\">criminal investigation into Fed chair Jerome Powell<\/a> remains uncertain, to the extent that it was intended to pressure him into prematurely forfeiting office, it has failed.<\/p>\n<div>\n<p id=\"trump-seems-to-be-retreating-on-martial-law\">\n<h2><strong>Trump seems to be retreating on martial law<\/strong><\/h2>\n<\/p>\n<\/div>\n<p>This week brought one other, quieter indication of democratic resilience.<\/p>\n<p>In 2025, the Trump administration repeatedly <a href=\"http:\/\/www.vox.com\/politics\/416105\/trump-national-guard-newsom-la-protests-immigration\">surged federalized National Guard troops<\/a> to Democratic-run cities in the name of putting down civil unrest \u2014 or else, merely deterring protests that the president doesn\u2019t like.<\/p>\n<p>In a <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/06\/department-of-defense-security-for-the-protection-of-department-of-homeland-security-functions\/\">June memorandum<\/a>, Trump authorized the Guard\u2019s deployment to any \u201clocations where protests against\u201d ICE functions \u201care occurring or are likely to occur based on current threat assessments and planned operations.\u201d<\/p>\n<p>In other words, he asserted the authority to send the military anywhere in the US where a demonstration against his immigration agenda is happening or <em>might<\/em> soon occur.<\/p>\n<p>This contravened a bedrock norm of American democracy. In the United States, responsibility for upholding civil laws is supposed to lie with civilian officials \u2014 not the military \u2014 except under the most extraordinary circumstances.<\/p>\n<p>Happily, the administration\u2019s weaponization of the National Guard provoked <a href=\"https:\/\/calmatters.org\/justice\/2025\/12\/trump-national-guard-los-angeles-ruling\/\">rebukes<\/a> from the judiciary, including the <a href=\"https:\/\/www.scotusblog.com\/2025\/12\/supreme-court-rejects-trumps-effort-to-deploy-national-guard-in-illinois\/\">conservative-dominated Supreme Court<\/a>. And on Wednesday, the Washington Post <a href=\"https:\/\/www.washingtonpost.com\/national-security\/2026\/02\/11\/national-guard-los-angeles-chicago-portland\/?utm_campaign=wp_main&#038;utm_source=bluesky,facebook,threads,twitter&#038;utm_medium=social\">reported<\/a> that the Trump administration had withdrawn all federalized National Guard troops from U.S. cities.<\/p>\n<div>\n<p id=\"american-democracy-isnt-going-down-without-a-fight\">\n<h2><strong>American democracy isn\u2019t going down without a fight<\/strong><\/h2>\n<\/p>\n<\/div>\n<p>This basic pattern \u2014 of the administration trying but failing to perpetrate a nightmarishly authoritarian act \u2014 has repeated itself on many other fronts over the past year.<\/p>\n<p>The Federal Communications Commission tried to bully Disney into <a href=\"http:\/\/www.vox.com\/politics\/461887\/jimmy-kimmel-suspension-air-abc-charlie-kirk-nexstar\">taking Jimmy Kimmel off the air<\/a> for telling jokes it did not like; entertainment unions and Disney+ subscribers threatened to boycott the company if Kimmel were fired, <a href=\"http:\/\/www.vox.com\/politics\/462570\/jimmy-kimmel-trump-abc-disney-boycott-hulu-show-kirk-sinclair-nexstar\">and the network reinstated him<\/a>.<\/p>\n<div>\n<p>When Border Patrol agents in Minnesota <a href=\"http:\/\/www.vox.com\/policy\/476397\/minneapolis-alex-pretti-ice-cbp-killing-shooting-video\">fired 10 times at the prone body of protestor Alex Pretti<\/a>, the administration tried to vilify the victim and glorify his killers. But citizens and officials in both parties responded by <a href=\"http:\/\/www.vox.com\/politics\/476592\/alex-pretti-ice-shooting-trump-noem-bovino\">demanding an investigation into the shooting<\/a>, and the Justice Department <a href=\"https:\/\/www.nytimes.com\/2026\/01\/30\/us\/politics\/justice-dept-civil-rights-pretti.html\">grudgingly obliged<\/a>.<\/p>\n<\/div>\n<p>Meanwhile, the backlash to Pretti\u2019s killing eventually forced the administration to draw down its <a href=\"https:\/\/www.reuters.com\/world\/us\/minnesota-ice-drawdown-underway-surge-should-end-trumps-border-czar-says-2026-02-12\/\">unprecedented deportation surge<\/a> in Minnesota, which had been generating <a href=\"http:\/\/www.vox.com\/politics\/476398\/minneapolis-fatal-shooting-border-patrol-ice-alex-pretti\">routine violations<\/a> of residents\u2019 civil liberties.<\/p>\n<div>\n<p>The White House has waged open war <a href=\"http:\/\/www.vox.com\/politics\/476263\/trump-ice-minnesota-constitution-renee-good\">on the due process rights<\/a> of immigrants, with no small amount of success. But one of its most egregious violations of such liberties \u2014 the <a href=\"http:\/\/www.vox.com\/politics\/408528\/trump-el-salvador-alien-enemies-gang-deportation-supreme-court\">unlawful deportation of Kilmar Abrego Garcia<\/a> to a foreign prison infamous for<a href=\"https:\/\/www.hrw.org\/news\/2025\/03\/20\/human-rights-watch-declaration-prison-conditions-el-salvador-jgg-v-trump-case\"> torturing its inmates<\/a> \u2014 was rebuffed by federal judges. And the administration eventually <a href=\"https:\/\/abcnews.com\/US\/mistakenly-deported-kilmar-abrego-garcia-back-us-face\/story?id=121333122\">repatriated Garcia<\/a>.<\/p>\n<\/div>\n<div>\n<p>Likewise, the administration tried to deport a Tufts student for <a href=\"https:\/\/www.cnn.com\/2026\/01\/23\/politics\/court-documents-student-israel-op-ed\">authoring an op-ed<\/a> it disagreed with, <a href=\"https:\/\/www.cnn.com\/2026\/02\/09\/us\/rumeysa-ozturk-immigration-detention-terminated\">only to lose in court.<\/a><\/p>\n<\/div>\n<p>Perhaps, most importantly, although the president has broadcast an interest in <a href=\"http:\/\/www.vox.com\/politics\/478263\/trump-midterms-2026-rigged-election-fulton-county-gabbard-bondi\">unduly influencing elections<\/a> in his favor, Democrats have nonetheless dominated <a href=\"https:\/\/guce.yahoo.com\/consent?brandType=nonEu&#038;gcrumb=NshbXeE&#038;lang=en-CA&#038;done=https%3A%2F%2Fca.news.yahoo.com%2Fwave-starts-democrats-win-another-164849991.html\">special<\/a> and <a href=\"https:\/\/www.politico.com\/news\/2025\/11\/05\/democrats-2025-win-midterms-virginia-new-jersey-00637057\">off-year elections<\/a> since Trump took office.<\/p>\n<div>\n<p id=\"the-state-of-the-union-is-still-horrible\">\n<h2><strong>The state of the union is still\u2026 horrible<\/strong><\/h2>\n<\/p>\n<\/div>\n<p>None of this is cause for complacency or comfort. A great many of the Trump administration\u2019s attempts to subvert the rule of law have succeeded.<\/p>\n<div>\n<p>The president has <a href=\"http:\/\/www.vox.com\/policy\/395860\/trump-executive-orders-democracy-january-6-pardon-birthright-schedule-f\">freed insurrectionists<\/a> who attacked the Capital in his name while <a href=\"https:\/\/www.nytimes.com\/2026\/02\/07\/us\/renee-good-investigation-minnesota-trump.html\">barring a federal investigation<\/a> into Renee Good\u2019s killing. He has <a href=\"https:\/\/www.pbs.org\/newshour\/nation\/how-the-trump-administration-erased-centuries-of-justice-department-experience\">purged<\/a> the Justice Department of career prosecutors loyal to the Constitution and replaced them with allies loyal above all to himself. His administration has <a href=\"https:\/\/www.washingtonpost.com\/politics\/2025\/07\/21\/trump-court-orders-defy-noncompliance-marshals-judges\/\">nullified many court orders<\/a> and, at least allegedly, immigrant <a href=\"https:\/\/www.aclu.org\/news\/immigrants-rights\/detained-immigrants-detail-physical-abuse-and-inhumane-conditions-at-largest-immigration-detention-center-in-the-u-s\">detainees\u2019 human rights<\/a>. It has intimidated <a href=\"https:\/\/www.reuters.com\/legal\/litigation\/trump-cbs-lawsuit-settlement-was-right-decision-says-media-mogul-shari-redstone-2025-12-03\/\">news organizations<\/a> and <a href=\"https:\/\/www.nytimes.com\/2025\/08\/20\/us\/politics\/law-firms-free-work-trump-administration.html\">law firms<\/a> into granting the president concessions to avoid legal trouble.<\/p>\n<\/div>\n<p>What\u2019s more: So long as Republicans control the Senate, America\u2019s judiciary is bound to <a href=\"https:\/\/www.reuters.com\/legal\/government\/trump-kicks-off-2026-with-4-new-judicial-nominees-2026-01-07\/\">grow more deferential to Trump<\/a> over time, as his handpicked judges occupy an ever larger share of its seats.<\/p>\n<p>The point then is not that things in America are going well, only that, were the president able to fully execute his will, they would be going incalculably worse.<\/p>\n<p>One year in, this administration\u2019s intentions have proven about as nefarious as predicted.
