(Francis Chung\/POLITICO via AP Images)\t\t\t<\/figcaption><\/div>\n<div>\n<p>Democrats have <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2025\/12\/95-2026-06-01-Notice-of-appeal.pdf\" data-type=\"link\" data-id=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2025\/12\/95-2026-06-01-Notice-of-appeal.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">appealed<\/a> a ruling that <a href=\"https:\/\/www.democracydocket.com\/news-alerts\/judge-denies-attempt-to-stop-trumps-mail-voting-order\/\" data-type=\"link\" data-id=\"https:\/\/www.democracydocket.com\/news-alerts\/judge-denies-attempt-to-stop-trumps-mail-voting-order\/\" target=\"_blank\" rel=\"noreferrer noopener\">refused<\/a> to block President Donald Trump\u2019s anti-mail voting executive order as the administration moves to carry it out \u2014 a major escalation in one of the most consequential voting rights battles ahead of the 2026 midterms.<\/p>\n<p>The Democratic plaintiffs* <a href=\"https:\/\/www.democracydocket.com\/cases\/trump-mail-in-voting-executive-order-challenge-dscc\/\" data-type=\"link\" data-id=\"https:\/\/www.democracydocket.com\/cases\/trump-mail-in-voting-executive-order-challenge-dscc\/\" target=\"_blank\" rel=\"noreferrer noopener\">challenging<\/a> the order filed a notice of appeal Monday, asking the U.S. Circuit Court of Appeals for the D.C. Circuit to reviewJudge Carl Nichols\u2019 denial of their request for a preliminary injunction \u2014 an emergency court order that would have temporarily stopped Trump\u2019s directive while the case continues.<\/p>\n<p>Trump\u2019s order seeks to reshape how mail-in voting works in federal elections by pushing federal agencies to create voter eligibility lists and directing the U.S. Postal Service to limit delivery of mail-in ballots based on those lists.<\/p>\n<p>Voting rights advocates and civil rights groups have warned that the scheme could inject chaos into elections, wrongly block eligible voters from receiving ballots and seize power that, under the U.S. Constitution, belongs to states and Congress.<\/p>\n<p>Nichols, a Trump appointee, declined to block the order last week, holding that the challenge was premature because the administration had not yet fully implemented the policy. His ruling did not decide whether Trump\u2019s order is lawful, and it left the door open for future challenges if the administration moves ahead.<\/p>\n<p>Those next steps may already be coming. <\/p>\n<p>After the ruling, USPS <a href=\"https:\/\/www.democracydocket.com\/news-alerts\/postal-service-trump-attack-mail-voting-proposed-rule\/\" data-type=\"link\" data-id=\"https:\/\/www.democracydocket.com\/news-alerts\/postal-service-trump-attack-mail-voting-proposed-rule\/\" target=\"_blank\" rel=\"noreferrer noopener\">issued<\/a> a proposed rule to implement parts of Trump\u2019s order, including new ballot mail requirements and a system for states to submit lists of voters receiving mail-in ballots.<\/p>\n<p>\u201cWe are ready to resume the fight if and when the administration takes those next steps,\u201d Juan Proa\u00f1o, chief executive officer of the League of United Latin American Citizens, one of the other plaintiffs challenging the order, said.<\/p>\n<p>The appeal means Democrats are not waiting for Trump\u2019s mail voting plan to harden into election machinery. They\u2019re asking a higher court to intervene now, before a president who has repeatedly attacked mail-in voting can use federal agencies to rewrite the rules ahead of national elections.<\/p>\n<p><em>*The Democratic plaintiffs in this case are represented by Elias Law Group (ELG).
