After the election, some of the country\u2019s largest companies announced they too were sunsetting some of their corporate programs.<\/p>\n<p>In December, Walmart <a href=\"https:\/\/www.theguardian.com\/business\/2024\/dec\/15\/walmart-dei-diversity-equity-inclusion-rollback\" data-link-name=\"in body link\">said<\/a> it was rolling back its diversity, equity and inclusion (DEI) goals and would drop using the term altogether. McDonald\u2019s made a similar <a href=\"https:\/\/www.theguardian.com\/business\/2025\/jan\/06\/mcdonalds-diversity-programs\" data-link-name=\"in body link\">statement<\/a> in January. On Friday, Meta became the latest major company to <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/jan\/10\/meta-ending-dei-program\" data-link-name=\"in body link\">announce<\/a> the end of its DEI goals, saying that the company will scrap its DEI team, its equity and inclusion training programs and requirements to have a \u201cdiverse slate\u201d of applicants when hiring.<\/p>\n<p>Though some of the announcements followed conservative pressure on social media, some came unprompted, suggesting that companies who were quick to trumpet their desire to broaden their workforce after the backlash to the murder of <a href=\"https:\/\/www.theguardian.com\/us-news\/george-floyd\" data-link-name=\"in body link\">George Floyd<\/a> have cooled on an idea that seeks to increase opportunities for women, people of color, LGBTQ+ people and other marginalized groups.<\/p>\n<p>Now that conservatives not only have a majority in the <a href=\"https:\/\/www.theguardian.com\/us-news\/us-supreme-court\" data-link-name=\"in body link\">supreme court<\/a>, but also the White House and both chambers of Congress, they can launch a full-fledged attack against DEI at the federal level.<\/p>\n<p>But DEI advocates maintain this isn\u2019t the end. Here\u2019s how Trump\u2019s second term could impact DEI.<\/p>\n<h2 id=\"an-executive-order-banning-dei-in-the-federal-government\"><strong>An executive order banning DEI in the federal government<\/strong><\/h2>\n<p>Toward the end of Trump\u2019s first term in 2020, Trump signed an executive order that banned diversity training in government agencies, contractors and institutions that receive federal funding, such as non-profits. It also restricted the use of so-called \u201cdivisive concepts\u201d that the administration deemed common in such training.<\/p>\n<p>The administration was quickly hit with lawsuits over first amendment violations in the order, and a federal judge blocked it soon after.<\/p>\n<figure id=\"29f389fd-2609-4dd9-8203-d2991944648b\" data-spacefinder-role=\"richLink\" data-spacefinder-type=\"model.dotcomrendering.pageElements.RichLinkBlockElement\"><gu-island name=\"RichLinkComponent\" priority=\"feature\" deferuntil=\"idle\" props=\"{\"richLinkIndex\":8,\"element\":{\"_type\":\"model.dotcomrendering.pageElements.RichLinkBlockElement\",\"prefix\":\"Related: \",\"text\":\"Trump promises a crackdown on diversity initiatives. Fearful institutions are dialing them back already\",\"elementId\":\"29f389fd-2609-4dd9-8203-d2991944648b\",\"role\":\"richLink\",\"url\":\"https:\/\/www.theguardian.com\/us-news\/2024\/dec\/05\/trump-dei-initiatives-colleges\"},\"ajaxUrl\":\"https:\/\/api.nextgen.guardianapps.co.uk\",\"format\":{\"design\":0,\"display\":2,\"theme\":0}}\"><\/gu-island><\/figure>\n<p>After <a href=\"https:\/\/www.theguardian.com\/us-news\/joebiden\" data-link-name=\"in body link\">Joe Biden<\/a> took office, he <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/06\/25\/fact-sheet-president-biden-signs-executive-order-advancing-diversity-equity-inclusion-and-accessibility-in-the-federal-government\/\" data-link-name=\"in body link\">signed<\/a> an executive order that asked government agencies to establish or promote chief diversity officers, hold DEI training and develop their own DEI plans.<\/p>\n<p>Trump and his allies have <a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/dec\/05\/trump-dei-initiatives-colleges\" data-link-name=\"in body link\">railed against DEI<\/a> and will likely target it again once he takes office. While it is unclear exactly what a new anti-DEI executive order from Trump would look like, he will likely scrap Biden\u2019s executive order and once again target DEI goals in the federal government.<\/p>\n<p>Such an order can\u2019t impact private companies, even if Trump\u2019s administration would want it to. A federal appeals court <a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/mar\/05\/florida-stop-woke-act-court-ruling-desantis\" data-link-name=\"in body link\">upheld<\/a> a ruling this year against Florida governor Ron DeSantis, who tried to ban private employers from diversity training, on first amendment grounds.<\/p>\n<h2 id=\"judicial-appointments\"><strong>Judicial appointments<\/strong><\/h2>\n<p>Trump appointed more than 200 federal judges to courts around the country during his first term, in addition to the three justices he got on to the supreme court.<\/p>\n<p>Trump\u2019s impact on the judiciary from his first term is already weighing on the dozens of DEI cases that are still ongoing in federal courts around the country.<\/p>\n<p>\u201cThat\u2019s going to shape the ongoing direction of the law of DEI in the years ahead and solidifies that the interpretation of laws that protect DEI will be moving in a conservative direction,\u201d said David Glasgow, executive director of the Meltzer Center for Diversity, Inclusion and Belonging at the NYU School of Law.<\/p>\n<p>After Students for Fair Admissions \u2013 the supreme court case that overturned affirmative action in higher education \u2013 was <a href=\"https:\/\/www.theguardian.com\/law\/2023\/jun\/29\/us-supreme-court-affirmative-action-harvard-unc-ruling\" data-link-name=\"in body link\">decided in 2023<\/a>, workplace programs became the next target. Edward Blum, the conservative legal activist who was behind the affirmative action case, said the case was only \u201cthe end of the beginning\u201d.<\/p>\n<p>The Meltzer Center is <a href=\"https:\/\/advancingdei.meltzercenter.org\/cases\/\" data-link-name=\"in body link\">tracking<\/a> 68 ongoing cases that are still in court. Many of the <a href=\"https:\/\/www.theguardian.com\/law\/article\/2024\/sep\/06\/dei-affirmative-action-lawsuits\" data-link-name=\"in body link\">lawsuits<\/a> focus on targeted programs such as scholarship, grants or initiatives for specific affinity groups. Others focus on reverse discrimination in the workplace, for example, white job applicants or employees suing companies for allegedly giving preference to their nonwhite counterparts.<\/p>\n<p>More Trump-appointed judges means even if these cases don\u2019t get up to the supreme court, lower courts that are conservative-leaning could set legal precedents that shape the legal landscape around DEI for years to come.<\/p>\n<p>Conservative judges could interpret laws that were established during the civil rights era to uphold claims of reverse racism, which have skyrocketed since Students for Fair Admissions.<\/p>\n<h2 id=\"congress-and-the-department-of-justice\"><strong>Congress and the Department of Justice<\/strong><\/h2>\n<p>On the campaign trail, Trump himself railed against what he called \u201canti-white feeling in this country\u201d, telling Time in May that he <a href=\"https:\/\/time.com\/6972270\/donald-trump-anti-white-bias-exclusive\/\" data-link-name=\"in body link\">thinks<\/a> \u201cthe laws are very unfair now\u201d.<\/p>\n<p>Trump\u2019s administration can utilize the legal powers of the Department of Justice, which can prosecute state and local government employers, or the Equal Employment Opportunity Commission (EEOC), which has enforcement power over private companies, to carry out what it deems are reverse discrimination cases.<\/p>\n<p>\u201cRight now, all the anti-DEI lawsuits are coming from private advocacy groups or individuals. They\u2019re not coming from the government,\u201d Glasgow said. \u201cIf the federal government uses its enforcement power to go after private companies, then that could have a chilling effect.\u201d<\/p>\n<figure data-spacefinder-role=\"inline\" data-spacefinder-type=\"model.dotcomrendering.pageElements.NewsletterSignupBlockElement\"><a data-ignore=\"global-link-styling\" href=\"http:\/\/www.theguardian.com\/#EmailSignup-skip-link-25\">skip past newsletter promotion<\/a><\/p>\n<p id=\"EmailSignup-skip-link-25\" tabindex=\"0\" aria-label=\"after newsletter promotion\" role=\"note\">after newsletter promotion<\/p>\n<\/figure>\n<p>Incoming vice-president <a href=\"https:\/\/www.theguardian.com\/us-news\/jd-vance\" data-link-name=\"in body link\">JD Vance<\/a> co-sponsored a self-explanatory bill in the Senate earlier this year named Dismantle DEI that would end all federal DEI programs, including for agencies, contracts and schools or organizations that receive federal funding.<\/p>\n<figure id=\"3ec152ec-bfa2-4717-8851-f2050f6943f6\" data-spacefinder-role=\"richLink\" data-spacefinder-type=\"model.dotcomrendering.pageElements.RichLinkBlockElement\"><gu-island name=\"RichLinkComponent\" priority=\"feature\" deferuntil=\"idle\" props=\"{\"richLinkIndex\":27,\"element\":{\"_type\":\"model.dotcomrendering.pageElements.RichLinkBlockElement\",\"prefix\":\"Related: \",\"text\":\"Fears for civil rights as Trump taps Maga darling for key justice department role\",\"elementId\":\"3ec152ec-bfa2-4717-8851-f2050f6943f6\",\"role\":\"richLink\",\"url\":\"https:\/\/www.theguardian.com\/us-news\/2024\/dec\/17\/justice-department-civil-rights-division\"},\"ajaxUrl\":\"https:\/\/api.nextgen.guardianapps.co.uk\",\"format\":{\"design\":0,\"display\":2,\"theme\":0}}\"><\/gu-island><\/figure>\n<p>The legislation would be more sweeping than what Trump could muster with an executive order. Republicans have a majority in both the House and Senate and could get it to Trump\u2019s desk, if they choose. But with slim majorities, particularly in the House, Republicans will need the political will to get the bill passed.<\/p>\n<h2 id=\"a-chilling-effect\"><strong>A chilling effect<\/strong><\/h2>\n<p>When Floyd was murdered in 2020, the ensuing protests around the countries encouraged companies to introduce or expand DEI programs. Commitments were made, DEI offices were created and executives were hired.<\/p>\n<p>But after the Students for Fair Admissions decision, companies went quiet. Even though the decision didn\u2019t mention the workplace, private employers stopped touting their commitments to diversity.<\/p>\n<p>DEI advocates are worried that Trump\u2019s second term will mean an even more widespread chilling effect, where companies do away with their DEI initiatives out of fear of retaliation.<\/p>\n<p>\u201cI\u2019ve had leaders tell me things like, \u2018Even the people who support DEI within our company are scared right now,\u2019\u201d Glasgow said. \u201cThere\u2019s a lot of fear and anxiety out there \u2026 even if, from a policy or senior leadership standpoint, these organizations still buy into [DEI].\u201d<\/p>\n<p>When Meta announced to its employees that it was dropping its DEI goals, the company said in a <a href=\"https:\/\/www.axios.com\/2025\/01\/10\/meta-dei-programs-employees-trump\" data-link-name=\"in body link\">statement<\/a> that \u201cthe legal and policy landscape surrounding diversity, equity and inclusion efforts in the United States is changing now\u201d.<\/p>\n<p>\u201cThe term \u2018DEI\u2019 has also become charged, in part because it is understood by some as a practice that suggests preferential treatment of some groups over others,\u201d the statement read.<\/p>\n<p>But Glasgow and other researchers at the Meltzer Center say that companies shouldn\u2019t drop their DEI initiatives completely.<\/p>\n<p>Researchers have <a href=\"https:\/\/hbr.org\/2024\/11\/what-trumps-second-term-could-mean-for-dei\" data-link-name=\"in body link\">outlined<\/a> ways companies can support DEI, even when the legal environment around it is murky. Companies can be careful not to scrap initiatives that are legally protected and think about areas where DEI could expand legally. Companies could also focus on making sure their companies are inclusive internally, without pushing for broader change outside the company.<\/p>\n<p>\u201cNo matter how hostile the external environment becomes, we can still make sure that our policies are protecting vulnerable workers,\u201d Glasgow said.<\/p>\n<figure id=\"7f270743-e9c5-43bc-bb6c-c60a0cd62afa\" data-spacefinder-role=\"richLink\" data-spacefinder-type=\"model.dotcomrendering.pageElements.RichLinkBlockElement\"><gu-island name=\"RichLinkComponent\" priority=\"feature\" deferuntil=\"idle\" props=\"{\"richLinkIndex\":39,\"element\":{\"_type\":\"model.dotcomrendering.pageElements.RichLinkBlockElement\",\"prefix\":\"Related: \",\"text\":\"How the US supreme court\u2019s affirmative action ruling unleashed anti-DEI cases\",\"elementId\":\"7f270743-e9c5-43bc-bb6c-c60a0cd62afa\",\"role\":\"richLink\",\"url\":\"https:\/\/www.theguardian.com\/law\/article\/2024\/sep\/06\/dei-affirmative-action-lawsuits\"},\"ajaxUrl\":\"https:\/\/api.nextgen.guardianapps.co.uk\",\"format\":{\"design\":0,\"display\":2,\"theme\":0}}\"><\/gu-island><\/figure>\n<p>And some companies can become public advocates of DEI, against the conservative tide.<\/p>\n<p>\u201cI would like to see organizations that have a powerful voice and a powerful platform actually speaking up in defense of DEI and contributing to a conversation about why DEI is important in the public sphere, to push back on those anti-DEI narratives,\u201d Glasgow added.<\/p>\n<p>In late December, Costco\u2019s board of directors released a statement pushing back against a shareholder proposal from a conservative thinktank that would require the company to evaluate and release a report on its DEI initiatives.<\/p>\n<p>\u201cA diverse group of employees helps bring originality and creativity to our merchandise offerings,\u201d Costco said in a <a href=\"https:\/\/www.cnn.com\/2024\/12\/27\/business\/costco-dei\/index.html\" data-link-name=\"in body link\">statement<\/a> to investors. \u201cWe believe (and member feedback shows) that many of our members like to see themselves reflected in the people in our warehouses with whom they interact.\u201d<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Even before Donald Trump won the election in November, multiple companies with announced they were ending their diversity initiatives.
