The Supreme Court has allowed President Donald Trump to withhold about $4 billion in funding for food aid<\/a> for 42 million low-income Americans<\/a> this month, as the effects of the longest government <\/a>shutdown in history continue to ripple across the country. <\/p>\n

The court’s ruling, known as an administrative stay, came after the Trump Administration appealed<\/a> a federal judge’s order to fully fund the program by Friday. <\/p>\n

The administration had previously agreed to a judge\u2019s order to partially fund the Supplemental Nutrition Assistance Program, known as SNAP or food stamps, by about $5 billion from a contingency fund, but it has objected to paying another $4 billion to fully fund the program. <\/p>\n<\/div>\n

Justice Ketanji Brown Jackson\u2019s order gives a lower court additional time to consider the administration\u2019s request to only issue partial funding.<\/p>\n

The ruling will keep millions of Americans who are reliant on food aid on a knife’s edge. The benefits lapsed at the beginning of this month for the first time in the program\u2019s 60-year history, leaving many recipients reliant on food banks. <\/p>\n

Most SNAP beneficiaries are low-income families, seniors, and people with disabilities. They now face an anxious wait as the legal wrangling over the program continues in the coming weeks. <\/p>\n

Anti-hunger groups condemned the delay caused by the Supreme Court ruling. <\/p>\n

“The Trump Administration\u2019s decision to continue to fight against providing SNAP benefits furthers the unprecedented humanitarian crisis driven by the loss of the nation\u2019s most important and effective anti-hunger program,” said Crystal FitzSimons, president of the Food Research & Action Center (FRAC), a nonprofit that supports anti-hunger programs.<\/p>\n<\/div>\n

“This delay sends a troubling message: the Trump administration is not interested in addressing the urgent needs of people who are struggling in this country, and instead has chosen to prolong this unnecessary hardship,” she added in a statement. <\/p>\n

Longest shutdown in history <\/h2>\n

The SNAP program has become a political bargaining chip in the ongoing government shutdown<\/a>, which has dragged on as Republicans refuse to extend Affordable Care Act subsidies for low- and middle-income Americans, which are set to expire at the end of the year.<\/p>\n

The administration had initially planned to suspend SNAP payments altogether in November, citing a lack of funds due to the government shutdown.\u00a0<\/p>\n

But U.S. District Judge John McConnell in Providence, Rhode Island, ordered the administration on Oct. 31 to partially fund the program using emergency funds from the U.S. Department of Agriculture (USDA).\u00a0\u00a0<\/p>\n<\/div>\n

\n

That began a lengthy legal back-and-forth with the administration, which led to the payments being partially funded. <\/p>\n

On Thursday, in a separate ruling, Judge McConnell accused the Trump Administration of withholding SNAP payments for “political reasons” and ordered the USDA to give recipients 100% of their benefits.<\/p>\n

“The evidence shows that people will go hungry, food pantries will be overburdened, and needless suffering will occur,” McConnell said during a virtual court hearing.\u00a0<\/p>\n

The Department of Justice challenged McConnell’s ruling, telling the Supreme Court that it would “sow further shutdown chaos” by prompting “a run on the bank by way of judicial fiat.”<\/p>\n

But a gap between the Friday deadline in McConnell’s earlier ruling and the Supreme Court’s stay led some states to issue full SNAP payments. <\/p>\n<\/div>\n

Hours before the Supreme Court\u2019s order, the USDA released a memo to states saying it was working to comply with the order. That led to New York, New Jersey and Massachusetts directing state agencies issuing SNAP benefits in full for November. <\/p>\n

In a response to the Supreme Court’s decision, U.S. Attorney General Pam Bondi called McConnell\u2019s ruling “judicial activism at its worst.”<\/p>\n

\u201cA single district court in Rhode Island should not be able to seize center stage in the shutdown, seek to upend political negotiations that could produce swift political solutions for SNAP and other programs, and dictate its own preferences for how scarce federal funds should be spent,\u201d she wrote on X.<\/p>\n

Behind Justice Jackson’s ruling <\/strong><\/h2>\n

Jackson, a former President Joe Biden appointee, has emerged during Trump\u2019s second term as a key dissenter<\/a> on some of Trump\u2019s key policies\u2014particularly regarding emergency appeals.<\/p>\n

Steve Vladeck, professor of law at the Georgetown University Law Center, wrote in response to the order that Jackson was \u201cstuck between a rock and a hard place.\u201d<\/p>\n<\/div>\n

\n

\u201c[T]he way she structured the stay means that she was able to try to control the timing of the Supreme Court\u2019s (forthcoming) review\u2014and to create pressure for it to happen faster than it otherwise might have,\u201d Vladeck wrote in his newsletter<\/a>. Jackson writes more in her stay than any Justice usually would, wrote Vladeck, which sends a specific message. \u201cHere, Justice Jackson is clearly telling the First Circuit to hustle\u2014a message I am sure the court of appeals will receive and act upon.\u201d<\/p>\n

Vladeck postulated that the liberal Justice Jackson likely administered the stay because she believed it would be \u201cworse\u201d if one of her colleagues released an administrative stay that would have been an indefinite pause for the Trump Administration. Her ruling, though, allows her to \u201cdirectly influence the timing\u201d of both the lower court and the Supreme Court, Vladeck added. <\/p>\n

What is SNAP?<\/strong><\/h2>\n

Normally, SNAP benefits<\/a> are paid monthly to eligible Americans who, usually, must have a gross monthly income <\/a>at or below 130% of the federal poverty guidelines<\/a>.<\/p>\n<\/div>\n

According to a report by the Center on Budget and Policy Priorities (CBPP) think tank<\/a>, <\/a>more than 62% of SNAP participants are in families with children and more than 37% are in families with members who are older adults or are disabled.<\/p>\n

One of the nation’s largest aid providers, SNAP is seen by experts as a critical program for Americans and food aid organizations.<\/p>\n

One expert, Craig Gundersen, an economist at Baylor University, told TIME in March<\/a> that he teaches SNAP as a \u201cquintessential successful government program\u201d because it is well-directed towards low-income Americans, it is \u201creadily accepted\u201d by grocery stores around the nation, and it allows for autonomy for those who utilize the program.<\/p>\n

\u00a0\u201cWe have a lot of government programs which, from my perspective, are often belittling and insulting [to those who use them]. SNAP is not like that,\u201d Gunderson said at the TIME. \u201cIt gives people the dignity to shop at the same food stores as their family and friends, and also gives them the autonomy to make their own choices.\u201d<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
