The result gave the appearance that Trump had encouraged the Capitol Hill riots.<\/p>\n<p>On Sunday evening, BBC director general <b>Tim Davie<\/b> and CEO of news <b>Deborah Turness<\/b> handed in their <b>resignations<\/b>. BBC chair <b>Samir Shah <\/b>later acknowledged an <b>&#8220;error of judgement&#8221; <\/b>with the edit.<\/p>\n<p>For the White House, though, more needs to be done &#8211; lawyers for Trump have demanded <b>three actions<\/b>: a retraction of the documentary, an apology, and compensation.<\/p>\n<p>If the broadcaster does not comply, lawyers will proceed with legal action &#8211; seeking a sum of <b>$1bn (\u00a3760m)<\/b> in damages.<\/p>\n<p>The issue is still developing, as we\u2019ve yet to see the BBC comment on the legal threat. If he has got an arguable case and it\u2019s in time &#8211; but defamation law is incredibly complex.<\/p>\n<p>Defamation, in its simplest terms, protects someone\u2019s good standing from an unjustified attack that lowers how the public view them to such an extent that it has caused lasting harm.<\/p>\n<p>A claimant has to prove this harm before a judge &#8211;  the person or media organisation facing the claim has potential defences, including that the words were in the public interest or an honestly held opinion.<\/p>\n<p>The claimant has to generally show they have begun their claim within a year of the first publication, a rule that also applies to online archives. <\/p>\n<p>There are exceptions &#8211; but given the Panorama at the heart of this story was first broadcast and made available on the BBC iPlayer more than a year ago, the potential difficulty in bringing a case to a London court is obvious.<\/p>\n<p>However, the president might be thinking of suing in the US.<\/p>\n<p>There, the law is different &#8211; with different deadlines by state.
