Breyer said in his <a href=\"https:\/\/www.courtlistener.com\/docket\/70496361\/225\/newsom-v-trump\/\" target=\"_blank\">ruling<\/a> that command of the remaining 300 federalized National Guard troops must return to Gov. Gavin Newsom, who  sued the administration in June after it commandeered thousands of troops to quell protests over immigration enforcement in Los Angeles. <\/p>\n<p>Breyer ruled that deployment  illegal \u2014 a decision that was challenged and ultimately reversed by the 9th Circuit Court of Appeals. The court said the esoteric law Trump invoked to wrest command of the Guard from the governor  afforded him \u201ca great level of deference\u201d to determine whether a rebellion was underway in Los Angeles, as the Justice Department claimed at the time. <\/p>\n<p>The same sequence repeated this autumn in Oregon, where 200 California Guard troops were sent to help quash demonstrations outside an ICE facility. But unlike in California, the Oregon decision was subsequently vacated, and is now under review by the appellate court, with one of    Trump\u2019s appointees to the bench appearing to  undercut his earlier order in lengthy filing Tuesday. <\/p>\n<p>Meanwhile, the Supreme Court is weighing an almost identical challenge to the deployment in Illinois. <\/p>\n<div data-click=\"enhancement\" data-align-center>\n<figure> <picture><source type=\"image\/webp\"  ><img alt=\"A demonstrator interacts with US marines and national guards standing in line\"   width=\"1200\" height=\"800\" src=\"https:\/\/ca-times.brightspotcdn.com\/dims4\/default\/8cb67f1\/2147483647\/strip\/true\/crop\/5000x3333+0+0\/resize\/1200x800!\/quality\/75\/?url=https%3A%2F%2Fcalifornia-times-brightspot.s3.amazonaws.com%2F96%2Fee%2Fdf6d063d4a069dba032d6cd85edb%2Fgettyimages-2222915300.jpg\" decoding=\"async\" loading=\"lazy\">   <\/picture>\n<div>\n<p>A demonstrator interacts with U.S. Marines and National Guard troops standing in line at the entrance of the Metropolitan Detention Center following federal immigration operations in July.<\/p>\n<p>(Etienne Laurent \/ AFP via Getty Images)<\/p>\n<\/p><\/div>\n<\/figure><\/div>\n<p>Department of Justice lawyers have argued that, once federalized, state Guard troops would remain under the president\u2019s command in perpetuity, a position Breyer called \u201ccontrary to law\u201d in his ruling Wednesday. <\/p>\n<p>\u201cAdopting Defendants\u2019 interpretation &#8230; would permit a president to create a perpetual police force comprised of state troops, so long as they were first federalized lawfully,\u201d Breyer wrote. \u201cDefendants\u2019 argument for a president to hold unchecked power to control state troops would wholly upend the federalism that is at the heart of our system of government.\u201d <\/p>\n<p>California leaders cheered the ruling as a turning of the tide in what until now has been an uphill legal battle to constrain the president\u2019s use of state troops. <\/p>\n<p>\u201cThe President deployed these brave men and women against their own communities, removing them from essential public safety operations,\u201d Newsom said in a statement Wednesday morning. \u201cWe look forward to all National Guard servicemembers being returned to state service.\u201d <\/p>\n<p>Atty. Gen.
